Article 1: In order to strengthen the management of ship inspection and testing services, standardize ship inspection and testing activities, improve the quality of ship inspection and testing, and ensure the safety of life and property on water, this law is formulated in accordance with relevant international conventions, the Regulations on Ship Inspection Management, and the technical specifications for ship statutory inspections. Article 2: These measures are applicable to the maintenance and testing activities of ships and water facilities within the territory of China, as well as the management of relevant units. The term "ship maintenance and testing" referred to in these Measures refers to the activities of institutions that meet the requirements of relevant technical conditions, carry out ship maintenance and testing within the corresponding business categories and scope, and issue ship maintenance and testing records, reports, or certificates in accordance with international conventions, ship statutory inspection technical specifications, and standards. Article 3 The Maritime Safety Administration of the China shall be responsible for formulating the technical conditions for ship inspection and testing service agencies, and supervising and managing the performance of relevant duties by ship inspection agencies. Article 4 The maritime administrative agency is entrusted by the Maritime Administration of the China to supervise and inspect the performance of relevant duties by the ship inspection agencies in the specified areas. Article 5: The ship inspection agency is responsible for controlling and supervising the safety, quality, and technical conditions of the ship inspection and testing service agency that accepts the inspection and testing results. Article 6 The categories and scope of ship inspection and repair business include: (1) life-saving equipment: inflatable liferafts, inflatable lifeboats, Marine evacuation system, inflatable Personal flotation device, immersion suits and lifeboats/rescue boats, landing devices, load bearing and release devices, etc; (2) Fire protection systems and equipment: fixed fire detection and alarm systems, fixed fire extinguishing systems, portable/wheeled fire extinguishers, firefighter equipment, emergency escape breathing devices, etc; (3) Navigation safety and radio equipment: radio device, navigation warning receiver, emergency radio position indicator, ship ground station, search and rescue positioning device, two-way wireless telephone, ship security alarm system, ship Automatic identification system, onboard navigation data recorder, etc; (4) Ship non-destructive testing and thickness measurement: radiographic testing, ultrasonic testing, magnetic particle testing, penetration testing, etc; (5) Ship noise detection; (6) Other categories required by conventions, regulations, and norms. Article 7 The format of the records, reports and certificates of ship overhaul and inspection shall be formulated by the Maritime Safety Administration of the China. If other flag state governments have other requirements for ships flying their flag, their regulations shall prevail. Chapter 2 Management Requirements for Ship Inspection Institutions Article 8 Ship inspection institutions shall establish and implement the following systems: (1) Technical condition control and supervision system for ship inspection and testing service institutions; (2) Safety quality control and supervision system for ship maintenance and testing service institutions; (3) The investigation system and reporting and complaint handling system related to ship maintenance and testing. Article 9 Where a ship inspection institution accepts the inspection and testing results of a ship inspection and testing service institution, it shall supervise and verify its technical conditions according to the technical conditions of the ship inspection and testing service institution published by the Maritime Safety Administration of the China. Ship inspection agencies shall not directly or indirectly add other restrictive technical requirements. The ship inspection agency shall record the supervision and verification results of the ship inspection and testing service agency into the China Maritime Comprehensive Service Platform for publication. Article 10: The ship inspection agency shall continuously supervise the technical conditions of the ship inspection and testing service agency that accepts the results, and conduct on-site supervision of the technical conditions at least once a year. The corresponding supervision results shall be recorded on the China Maritime Comprehensive Service Platform for publication. The ship inspection institution may recognize the results of other ship inspection institutions' supervision and verification of the technical conditions of ship maintenance and testing service institutions or on-site supervision of technical conditions, and shall record them in the China Maritime Comprehensive Service Platform for publication. Article 11: Ship inspection institutions shall coordinate, guide, and supervise the professional knowledge and skill training of ship maintenance and testing personnel. Article 12 Institutions conducting professional knowledge and skill training shall meet the following conditions: (1) having corresponding training materials; (2) Having the necessary teaching staff to meet the training content; (3) Possess maintenance and testing skills to operate the site and necessary equipment and facilities. Article 13: The ship inspection agency shall supervise the on-site technical conditions of the ship inspection and testing service agency that accepts the results, and shall verify the professional knowledge and actual inspection and testing skills of the ship inspection and testing personnel. Article 14: Ship inspection institutions shall include the inspection and testing quality of ship inspection and testing service institutions in the scope of ship inspection quality monitoring and management. The ship inspection agency shall not accept the inspection and testing results of the ship inspection and testing service agency that have not been published by this agency on the China Maritime Comprehensive Service Platform. The ship inspection agency shall regularly supervise the inspection and testing activities of the ship inspection and testing service agency on site. Article 15 If a ship inspection institution discovers quality issues in the process or results of ship maintenance and testing, it shall not rely on its inspection and testing results, and shall conduct investigations in accordance with relevant regulations. If the situation is serious or a request for rectification within a time limit is made, it shall be reported to the Maritime Safety Administration of the China in a timely manner. Article 16: If a ship inspection institution accepts the results of relevant ship maintenance and testing, it shall be responsible for the compliance of the inspection and testing records, reports, or proof results with the requirements of the ship's statutory inspection technical specifications. The ship inspection agency shall be responsible for the consistency of inspection records, reports or certificates with the visual appearance of the inspected equipment. Article 17 According to the technical requirements of ship maintenance and testing service institutions, ship inspection institutions shall not rely on the results of maintenance and testing conducted outside fixed premises for maintenance and testing activities that should be carried out inside fixed premises. If a ship inspection and testing service institution provides inspection and testing services for ships outside the scope of its province, autonomous region, or municipality directly under the central government, it shall report to the ship inspection institution that accepts the inspection and testing results before conducting inspection and testing services in fixed places. The ship inspection agency shall conduct on-site supervision of maintenance and testing activities. Article 18 Where a foreign ship survey company formulates the technical conditions for a ship inspection and testing service agency on its own, it shall meet the requirements of international conventions and report to the Maritime Safety Administration of the China.
